We invite you to call Patrick John McGinley and interview him for the job of being your appellate attorney. Perhaps these questions might be among those you might ask him.
Q. Why do you practice appellate law?
"Although I've been practicing law for more than 23 years," says Patrick John McGinley, "it took me a long time to accept that judges are human and humans make mistakes. When justice has been denied to my client, I find it rewarding to bring an appeal on my client's behalf. Sometimes, my client is not the one who filed the appeal, but instead, is facing the possibility that their trial victory might be taken away when the losing side filed an appeal. In those instances, I find it rewarding to defend the order on appeal and make sure that victory survives the appeal."
Q. Why are your fees better than some other appellate lawyers?
"I'm not the cheapest lawyer in town," admits Patrick John McGinley, "but my fees are competitive and often lower than other Board Certified Appellate Lawyers who have more than 20 years experience like I do. Here is why."
"Years ago, on my way through security at the Fifth District Court of Appeal, I saw a man in front of me looking lost," says Patrick John McGinley. "So I asked if I could help. He tells me he's here to argue his own appeal, because his appellate attorney refused to come to court today because he fell behind on paying the lawyer's bills. He asked me to help him find the courtroom. I told him I could help even more than that. I offered to argue his case for him, free of charge. I had only 1 hour to prepare, but I worked as hard and fast as I could. And even though my opposing counsel had months to prepare, nevertheless, I won that case. "
"The lesson I learned that day, " says McGinley, "is that too many appellate lawyers care more about their own paycheck than they do about their client. From that day forward, it has been my great honor to accept appeals on a contingency basis whenever possible, and for a competitive fee when a contingency is not allowed. That way, I can help people without worrying them about the legal bills."
Q. Why are you Board Certified in Appellate Practice by the Florida Bar when so few lawyers have this credential?
"It has never been my goal to be just a good appellate lawyer, but instead, it has always been my goal to be the best," says Patrick John McGinley. "By applying for then winning Board Certification, I let my peers decide whether my work was good enough, and whether I had the skills needed to call myself Board Certified. I am honored to be able to call myself Board Certified when so few other lawyers are allowed to do so," says McGinley.
"Maybe some appellate lawyers are comfortable with doing good work, but as for me, nothing but the best work is good enough," says McGinley.
